Assignment

A registered mark may be assigned with or without the goodwill of the business. Assignment may be for all or for one or some of the goods or services for which the mark is registered. If a whole enterprise is transferred together with its assets and liabilities, the rights to its marks shall be included in the transfer, except if provided otherwise. Assignment must be in writing and must be registered at the Patent Institute in order to be effective against third parties acting in good faith; registration may be requested by either party. The Institute may refuse to register an assignment if the same is likely to mislead the public with regard to the nature, quality or geographical origin of the goods or services for which the mark is registered; in such case the assignee may agree to limit the registration of the mark to goods or services with regard to which the assignment is not likely to be misleading, in order to overcome the Institute’s objections.

Right under an application for the registration of a mark may also be assigned.
